Privacy Policy

Veryon Website Privacy Policy

Veryon is committed to protecting the privacy of our customers.

Our Privacy Policy is designed to help you understand how we collect and use personally identifiable information ("Personal Information") that you provide us, and to help you make informed decisions when using our website and services (collectively, "Veryon", the "Company", or the "Website").

This Privacy Policy applies to all information collected through our website, our mobile applications ("Apps"), and your use of our SaaS products. Where we process Personal Information on behalf of a customer through our SaaS products, we act as a processor (or service provider) for that customer. That processing is governed by our agreement with the customer, and requests about that data should be directed to the customer.

This Privacy Policy applies to Veryon, including its subsidiaries and across our global organization, in all of the geographic regions where we operate. Region-specific disclosures are set out in the notices linked below, which supplement this Privacy Policy and prevail over it to the extent of any inconsistency for the individuals they cover.

If you are a resident of a U.S. state with a comprehensive privacy law, read the United States Regional Privacy Notice for details of the Personal Information we collect about you, the rights available to you, and how to exercise them.

By visiting or using any part of this website, you acknowledge this Privacy Policy as it may be amended from time to time. As we update our website over time, this Privacy Policy may change, so please check for updates.

Scope of This Privacy Policy

This Privacy Policy applies to Personal Information and other information collected by Veryon or its service providers from or about:

  • Visitors to, or users of, its websites

  • Prospective and current customers using Veryon services

  • Service providers and business partners

  • Prospective and current employees

  • Other third parties that it interacts with

We collect this information to continually improve and enhance the functionality of Veryon. We gather certain information automatically. This information may include IP addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We do not combine this automatically collected data with information you actively provide, except as described under "Website usage information" below.

Definitions

"Personal Information"
means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. Where this policy or the laws referenced in it use the term "Personal Data", it has the same meaning.

Personal Information may include the following: name, address, date of birth, gender, and contact data (for example, email address, telephone number, and employer name).

"Non-personal Information" means information that is related to you but that does not personally identify you. Non-personal Information also includes information that could personally identify you in its original form, but that we have modified — by aggregating, anonymizing or de-identifying it — in order to remove or hide any Personal Information.

"Controller" means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of Personal Information; where the purposes and means of such processing are determined by law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

"Processing" means any operation or set of operations performed on Personal Information, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

"Profiling" means any form of automated processing of Personal Information consisting of the use of Personal Information to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning that person's performance at work, economic situation, health, personal preferences, interests, reliability, behavior, location or movements.

For Personal Information collected through our website and our own business activities, the Controller is Veryon, located at 7001 Burnet Rd, 3rd Floor, Austin, TX 78757. Our Data Protection Officer can be reached at privacy@veryon.com.

Collection of Personal Information

We take your privacy seriously and employ information protection controls in keeping with industry standards and practices to safeguard your information and protect your anonymity. Personal Information about you may be collected from you through various sources, including information: (i) that is entered manually and voluntarily by you on the site's application and other forms or postings on the site; (ii) that you provide regarding your preferences, for example based on your activity on our website; (iii) from other sources with your consent, for example from other institutions such as auditors or administrators; (iv) from sources in the public domain; and (v) from other interactions you may have with us, for example discussions or emails with our staff, including through the use of the site's contact features.

You can use our website or Apps without actively disclosing Personal Information. You are not required to actively provide Personal Information as a condition of using our site, except as may be necessary to provide you with a product or service at your request. However, as part of the standard operation of the website, certain data is collected automatically or passively from or about you in connection with your visit.

In addition, when you visit our websites and our related services, we may gather technical and navigational information, such as computer browser type, Internet protocol address, cookie information, pages visited, and average time spent on our website. This information may be Personal Information under some laws (for example, IP addresses and cookie identifiers) and may be used, for example, to alert you to software compatibility issues, to customize any advertising or content you see, to fulfil your requests for products and services, to contact you, to conduct research, or to analyze and improve our site design and functionality.

Such information collected by us may be stored and processed in the United States or any other country in which we or our agents maintain facilities. By using the website and our services, you acknowledge the foregoing collection and use of information and any such transfer of information outside of your country. We make no representation or warranty with respect to any duty to permanently store any Personal Information you may provide.

Personal Information you choose to provide

In order to provide the best experience when you visit our website, we may ask you for Personal Information — for example, your name and e-mail address, both of which you may be asked to provide when registering with Veryon. A description of some of the ways in which you may provide Personal Information to us, and further detail on how we may use it, is given below.

Contact us / feedback
If you email us using a "Contact us" link on our website, we may ask you for information such as your name and e-mail address so we can respond to your questions and comments. If you choose to correspond with us via e-mail, we may retain the content of your e-mail messages, your e-mail address, and our response to you.

Surveys
We may occasionally ask website visitors to complete online surveys and opinion polls about their activities, attitudes and interests. These surveys help us improve our products and services. When asking for participation, we may ask you to provide your name and email address.

Website forms
Our website may offer visitors contact forms to request additional details and to download collateral. If you fill out one of our web forms, we may ask you for information such as your name and email address so we can respond to your questions and comments. If you choose to correspond with us via web forms, we may retain the form data, which can include name, email address and other contact-related details.

Website chat assistant
Our website offers an AI-powered chat assistant. It is an automated tool, not a person. It generates answers based on what you enter, and you should verify its answers before relying on them. When you use it, we collect what you type, your name and business contact details if you provide them, any meeting preferences, and technical information such as your IP address, device and browser details, and the pages you view.

Conversations are recorded and stored as transcripts and are shared with our chat service provider, and the AI model providers it uses to generate responses. We use them to answer your questions, qualify your inquiry, schedule meetings and route your request to our sales team, and we may transfer your contact details and the conversation to our customer relationship management system. By using the chat you acknowledge that your conversation will be recorded and shared in this way.

Please do not enter sensitive information in the chat, such as health, financial or government identification details, or confidential customer or aviation data. If you prefer not to use the chat, you can contact us through our Contact Us form or at sales@veryon.com.

Website usage information

When you visit and access our website, the following information is automatically stored in log files: Internet Protocol (IP) address, date, time, browser request, and general information about your operating system and browser. This data may be used to improve the content and usefulness of this website, to understand your usage, and to customize content based on your usage.

"Site Usage Information" includes, but is not limited to:

  • Your browser type, device type, carrier (if applicable), device address, operating system, operating system address, IP address, and the domain name from which you accessed a site;

  • Information about your region, continent, country, city, postal code, time zone, and general location; and

  • Information about your browsing activities on and through a site (also known as "click stream" data), such as the date and time you visit; the areas or pages you visit; the amount of time you spend viewing a site; the website or pages you visited before and after; social plug-ins you have interacted with; and other similar site usage data.

This data, which is collected automatically or passively from or about you, could possibly lead to your identification, but it is not used by us for that purpose.

We do not combine data you actively provide with data collected automatically or passively from you, except where you use our website chat assistant or submit a form. In those cases, we may associate your conversation and contact details with information about your visit and with the record we keep in our customer relationship management system.

Cookie Policy

We use cookies for marketing, authentication, and to operate our website chat assistant. Users can control the use of cookies at the individual browser level. If you reject cookies, you may still use our site, but your ability to use some features or areas of our site may be limited.

We use strictly necessary cookies on the basis of our legitimate interest in operating our website under Article 6(1)(f) of the General Data Protection Regulation (GDPR). Where consent is required, including for analytics and marketing cookies used by individuals in the EEA and the UK, we obtain it through our cookie banner before those cookies are set.

To learn more, please consult the Veryon Cookie Policy

Refusing a cookie may in some cases prevent you from using, or negatively affect the display or function of, our website or certain areas or features of it.

Social bookmarks

Social bookmarks (for example LinkedIn, Facebook or X) let you share pages with your contacts. Clicking one sends data to that platform under its own privacy policy; Veryon does not monitor or control that activity.

Your opt in / opt out choices

You may "opt in" and/or "opt out" of certain uses of your Personal Information. For example, you may have the opportunity to choose whether you would like to receive email correspondence from us. Your Personal Information will not be shared with third-party service providers for their own marketing purposes unless you give consent. AI and personal data

Veryon AIRE is designed to operate on de-identified operational and maintenance data. We do not use personal data about individuals to train our AI models. Where personal data is incidentally present in data you submit through our products, it is handled in accordance with this Privacy Policy and our data processing agreements.

Our website chat assistant is an automated tool that uses third-party large language models to generate responses. Those model providers do not use what you submit to train their models and are configured not to retain it. The assistant is intended for general questions about Veryon and its products, not for customer support.

Vendors, consultants and other third-party service providers

We may share your data with third-party vendors, service providers, contractors or agents ("third parties") who perform services for us or on our behalf and require access to such information to do that work. We have contracts in place with our third parties which are designed to help safeguard your Personal Information. This means that they cannot do anything with your Personal Information unless we have instructed them to do it. They will also not share your Personal Information with any organization apart from us. They also commit to protect the data they hold on our behalf and to retain it only for the period we instruct. The categories of third parties we may share Personal Information with are as follows:

Transfers of Personal Information

The services are hosted and operated by Veryon and its service providers in the United States (“U.S.”) and other countries as outlined in Veryon’s Trust Center. By using the services, you acknowledge that Veryon will transfer, store and process your information to and in such countries. If you are located in the European Economic Area (EEA) or otherwise entitled to protections under the GDPR, we take steps to ensure that your Personal Information receives a comparable level of protection to that which it would receive within the EEA, including by entering into data transfer agreements incorporating the European Commission approved Standard Contractual Clauses and, where applicable, the UK International Data Transfer Addendum. You may request a copy of the relevant safeguards by contacting privacy@veryon.com.

Security

To help protect the privacy of data and personally identifiable information you transmit through use of this site and any other related services, we maintain physical, technical and administrative safeguards. We update and test our security technology on an ongoing basis. We restrict access to your Personal Information to those employees who need to know that information to provide benefits or services to you. In addition, we train our employees on the importance of confidentiality and of maintaining the privacy and security of your information. We commit to taking appropriate disciplinary measures to enforce our employees' privacy responsibilities.

Any Personal Information that you provide to Veryon is encrypted in transit to prevent its possible misuse by third parties, and our security procedures are continuously revised in line with new technological developments.

For further information about our security procedures, please visit the Veryon Trust Center.

Data Retention and Storage

All Personal Information is retained only for as long as is necessary for the purposes for which it was collected or transferred. Veryon retains your information for business purposes, for as long as your account is active, and for as long as is reasonably necessary to provide you with our products and services. Veryon will also retain your information as reasonably necessary to comply with our legal obligations, resolve disputes and enforce our agreements. We may also retain cached or archived copies of your information for a reasonable period of time.

Where we process your Personal Information on the basis of your consent, you may withdraw that consent at any time and we will stop the processing that relied on it. Withdrawal does not affect the lawfulness of processing carried out before the withdrawal, and does not require us to delete information we are required or permitted to retain on another basis — for example, in connection with pending litigation or a statutory retention period.

Your Rights Over Your Personal Information

You may request access to your Personal Information in order to update, correct or delete it, or to limit its use or disclosure. Depending on where you live, you may have some or all of the following rights:

  • Access — to obtain confirmation of whether we process your Personal Information and a copy of it.

  • Rectification — to have inaccurate Personal Information corrected. We will use commercially reasonable efforts to correct inaccurate Personal Information as you may direct, taking into account the nature of the information and the purposes of the processing.

  • Erasure — to have your Personal Information deleted, subject to the exceptions permitted by law.Restriction — to have the processing of your Personal Information restricted in certain circumstances.

  • Objection — to object to the processing of your Personal Information, including processing for direct marketing purposes.

  • Portability — to receive your Personal Information in a structured, commonly used and machine-readable format and to have it transmitted to another controller.

  • Withdrawal of consent — where processing is based on your consent, to withdraw that consent at any time.

  • Non-discrimination — Veryon will never discriminate or retaliate against you for exercising any of these rights.

Individuals wishing to view, update, delete or supplement their Personal Information may do so by contacting the business that provided Veryon with their Personal Information directly, or by submitting a request through our Contact Us form. If the form is unavailable, requests can be sent to privacy@veryon.com, or by telephone on our toll-free requestor support line, 1-800-747-4560.

If you submit a request, you must provide enough information for us to identify you — for example, your first and last name and email address — and enough specificity about the data requested. We will only use the information we receive to respond to your request. We will not be able to disclose information if we cannot verify that the person making the request is the person about whom we collected the information, or someone authorized to act on that person's behalf.

If your request is submitted by an authorized agent, we will require you to upload documentation showing signed, written permission from the individual authorizing you to submit the request on their behalf. We reserve the right to require requestors to confirm their requests and their identity.

United States Regional Privacy Rights

Veryon does not sell, rent or lease your personally identifiable information to third parties, and does not derive any part of its revenue, or receive any discount or other compensation, from such sales. We do not "share" your Personal Information as that term is defined in the California Consumer Privacy Act.

If you are a resident of a U.S. state that has enacted a comprehensive consumer privacy law, additional rights and disclosures apply to you. Those rights, the categories of Personal Information we collect about you, how long we retain each category, and the process for submitting and appealing a request are set out in full in the United States Regional Privacy Notice, which forms part of this Privacy Policy. That Notice covers, among others, the privacy laws of California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, Nevada, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia.

Where the US Regional Privacy Notice and this Privacy Policy differ, the Notice prevails for the residents it covers.

Company Response to a Data Request

In regard to the rights described above, we will respond to your request within 30 days. In some cases we may limit or deny your request: where the law permits or requires us to do so; where it would infringe the privacy of other individuals; where we find the request to be unfounded or excessive; or where we are unable to verify your identity.

If the volume or complexity of the request requires internal processing beyond 30 days, Veryon will inform the requestor within 30 days of the reasons for the extension and may charge a reasonable fee to cover administrative costs.

See "Security" above for the safeguards we maintain. Those security measures cannot prevent all loss, misuse or alteration of Personal Information and, unless otherwise agreed in a written agreement between Veryon and the applicable party, we are not responsible or liable for any damages relating to any such incidents, to the fullest extent permitted by law.

In the event of a Personal Data breach affecting Personal Information for which Veryon is the controller, we will notify the relevant supervisory authority without undue delay and, where feasible, within 72 hours of becoming aware of it. Where the breach is likely to result in a high risk to your rights and freedoms, we will notify you without undue delay. Notifications to individuals under other applicable laws will be made within the timeframes those laws require. Where Veryon processes Personal Information on behalf of a customer, we will notify the customer of a breach without undue delay in accordance with our agreement with them, and notifications to individuals and authorities will be handled in accordance with that agreement and applicable law.

Children's Privacy

Veryon’s products and services are enterprise software solutions sold to business customers (“Subscribers”) for use by their own employees and authorized personnel, not directly to individual consumers. Our products and services are not intended for use by, and are not directed to, individuals under the age of 16. Subscribers are responsible for controlling and managing access to their instance of our products and services, including ensuring that their authorized users meet this age requirement.

If you believe a child has provided us with Personal Information, please contact privacy@veryon.com and we will delete it.

Fair Information Practices

In line with the Fair Information Practices, should a data breach occur we will notify affected users in accordance with the timeframes set out under "Company Response to a Data Request" above. We also agree to the individual redress principle, which requires that individuals have a right to pursue legally enforceable rights against data collectors and processors who fail to adhere to the law, and that individuals have recourse to courts or a government agency to investigate or prosecute non-compliance by data processors.

CAN-SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out penalties for violations. To be in accordance with CAN-SPAM, if at any time you would like to unsubscribe from receiving future emails you can email us at privacy@veryon.com and we will promptly remove you from all marketing correspondence.

Do Not Track

Veryon does not track its customers over time and across third-party websites to provide targeted advertising, and therefore does not respond to Do Not Track (DNT) signals. Third parties that have content embedded on Veryon's websites, such as a social feature, may set cookies on a user's browser and may obtain information about the fact that a web browser visited a specific Veryon website from a certain IP address. Third parties cannot collect any other Personal Information from Veryon's websites unless you provide it to them directly.

Notice to Individuals in Canada

We may process your information if you have given us specific permission (express consent) to use your Personal Information for a specific purpose, or in situations where your permission can be inferred (implied consent). You can withdraw your consent at any time.
In some exceptional cases, we may be legally permitted under applicable law to process your information without your consent, including for example:

  • If collection is clearly in the interests of an individual and consent cannot be obtained in a timely way

  • For investigations and fraud detection and prevention

  • For business transactions, provided certain conditions are met

  • If disclosure is required to comply with a subpoena, warrant, court order, or rules of court relating to the production of records

  • If the information is publicly available and is specified by the regulations

Notice to Individuals in the European Union, the United Kingdom and Switzerland

To facilitate our business practices, your Personal Information may be collected, transferred to, and stored by us in the United States. As a result, your Personal Information may be processed outside the EEA and in countries which are not subject to an adequacy decision by the European Commission, and which may not provide for the same level of data protection as the EEA. In this event we will ensure a comparable level of protection — for example by entering into standard contractual clauses for the transfer of data as approved by the European Commission under GDPR Article 46 — or we will ask you for your prior consent to such international data transfers.

We acknowledge the right of UK, EU and Swiss individuals to access their Personal Information, and to "opt in" and "opt out" of certain uses of it. See "Your Rights Over Your Personal Information" and "Your opt in / opt out choices" above.

Veryon commits to resolving complaints about your privacy and our collection or use of your Personal Information. Individuals with inquiries or complaints should use our Contact Us form. If the form is unavailable, requests can be sent to privacy@veryon.com or to our mailing address given under "Contact us" below.

If you are domiciled in the EEA or the UK, you also have the right to lodge a complaint with a supervisory authority if you do not agree with the processing of your Personal Information. A list of EEA supervisory authorities is maintained by the European Data Protection Board at edpb.europa.eu/about-edpb/about-edpb/members_en. In the United Kingdom, the supervisory authority is the Information Commission (ICO).

Veryon has appointed VeraSafe as its representative in the United Kingdom and the European Union for data protection matters, pursuant to GDPR Article 27.
